ITAR (International Traffic in Arms Regulations) and EAR (Export Administration Regulations) Compliance Statement
By ordering any product(s) from www.gooningear.com website, you certify that you, or third-party entities at your direction, will not sell, transport, ship or transfer outside the borders of the United States, nor to any foreign person*, any product(s) which are export-restricted by U.S. export-control law and regulation, without proper U.S. Government export authorization, licensing, and documentation.
Export-restricted items include, but are not limited to, electronic equipment, certain gear and accessories, handheld optical equipment including night vision and night vision accessories, holographic sight systems, “red-dot” optics, optic mounting systems, thermal vision, and tactical lights and lasers.
You must indicate on your order if you intend for an item(s) to be exported. An indication of desire of exportation in no way compels Goonin Gear LLC to assist with export in any way, before or after purchase of an item(s). Export, or attempt to export, any controlled or prohibited items outside of the U.S. without complying with U.S. export control regulations can result in severe civil and criminal penalties and/or constitute a federal crime. Goonin Gear LLC will not participate in any transaction, directly or indirectly, involving the illegal export or re-export of any prohibited items.
* “Foreign Person” under ITAR § 120.16 means “any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101 (a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3)”, and can mean “any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions).”
IF YOU ORDER AN ITAR CONTROLLED PRODUCT AND ARE NOT A UNITED STATES CITIZEN OR HAVE A SHIPPING ADDRESS OUTSIDE OF THE UNITED STATES YOUR ORDER WILL BE CANCELED AND SUBJECT TO A 15% CANCELLATION/RESTOCKING/REFUND FEE. THIS ALSO APPLIES IF YOU ATTEMPT TO ORDER ARMOR AND ARE A CONNECTICUT RESIDENT. NO EXEMPTIONS EVEN IF LE/MIL.

SHIPPING
Standard Shipping for stickers is via USPS First Class envelope without tracking. If you opt for the tier above Standard it will come with tracking.
Standard Shipping on most others items default to USPS First Class package service. Premium defaults to Priority. In items or groups of items not specified above typically the same rules apply for Standard/Premium; in some cases selection will retroactively default to First Class based on actual shipping costs charged to Goonin Gear LLC. FedEx is also utilized in certain shipments which may apply to either Standard or Premium selection.
ALL ORDERS MUST HAVE MATCHING BILLING AND SHIPPING ADDRESSES. IF ADDRESSES DO NOT MATCH YOUR ORDER WILL BE CANCELED AND SUBJECT TO A 3% CANCELLATION FEE LESS THE COST OF SHIPPING CHARGES

CLOTHING
Clothing is print on demand. On the rare occasion you are sent an incorrect product please send a picture of what you received to info@gooningear.com so we can swiftly replace it for you.
NIGHT VISION SHIPPING
Night Vision ships via signature confirmation/insured due to nature of the product.
Some items may be subject to a short lead time due to current events. Please contact us if you have any questions.
ARMOR
Standard shipping is USPS FLAT RATE insured up to $100
Premium is USPS FLAT RATE WITH FULL INSURANCE

RETURNS/CANCELLATIONS
Returns are not accepted unless the product arrives in catastrophic failure condition or is an incorrect product to what you ordered. Once an item is in the package carrier service possession Goonin Gear LLC is not responsible for happenstances to the items thereafter. Cancellations are generally not accepted. If you require a cancellation for a special circumstance submit an email to info@gooningear.com specifying your order number and reason for requesting a cancellation. The item/s must be in original unopened condition. Goonin Gear LLC will review the cancellation request and hold sole ability to allow or deny the request. If allowed the cancellation will be subject to a cancellation/refund/restocking fee of 15%, plus the cost of return shipping. In cases of an item being shipped directly to the customer from a distributor/partner of Goonin Gear LLC; a cancellation request will default to being treated as a “Return” and subject to a 15% restocking/refund fee plus the cost of return shipping. Only after the item arrives in Goonin Gear LLC’s possession will a refund amount be processed, provided the item is still in original condition. If you input an incorrect address for shipping, your order may be canceled and refunded less the cost of payment processing and restocking (15%.) Orders containing Night Vision are subject to terms below.
NIGHT VISION RETURNS/CANCELLATIONS/LEAD TIME
All Night Vision is subject to a lead time dependent on housing and tube selection. Lead times may vary between 2-12+ weeks. Please contact us for a lead time estimate of your intended device order. Returns are not accepted. Cancellations of an order containing Night Vision are subject to a 15% restocking/refund fee and are subject to Goonin Gear LLC’s discretion/approval to allow or deny and will only be considered within the first 5 business days. This applies even if the unit hasn’t been built yet to account for potential component orders in the pipeline and cancellation fees that follow suit with such. When purchasing Night Vision please do so with diligence and care. If you are unsure of your purchase please contact us prior to making a decision. By making a purchase from Goonin Gear LLC you agree to all terms above and contained within and in all respects of how Goonin Gear LLC interprets these terms beyond description. Agreement between purchasing party and Goonin Gear LLC is valid whether purchasing party acknowledges these terms or views policies page. Furthermore, by finalizing checkout utilizing any payment gateway, whether shown or not, purchasing party agrees to the terms contained within and in respect to interpretation by Goonin Gear LLC.
PURCHASER AGREEMENT
You agree to indemnify, defend, and hold harmless Goonin Gear LLC, its owners, members, licensors, and suppliers from and against all loses, expenses, damages, and costs. Including reasonable attorneys' fees, resulting from your purchase.
